In September 2015, Michael Duma’s client was charged with failing to submit an offender registration fee, a person felony in the state of Kansas. Michael drafted a motion and successfully argued that criminally penalizing individuals for an inability to pay a fine violates the equal protection and due process clauses of the United States and Kansas Constitutions. A Wyandotte County District Court Judge agreed with Michael, stating that the law was “unconscionable." All charges were dismissed and Michael’s client was relieved of his duty to pay the fee for the next three years.
